On October 25, 2022, Mr. Anucha Burachaisri, Deputy Secretary-General to the Prime Minister for Political Affairs acting as a spokesperson for the Prime Minister's Office, said at the Government House that the Cabinet meeting approved the principle of drafting the Ministerial Regulation on the acquisition of land to be used as residence for foreigners following the economy and investment stimulus measures by attracting high potential foreigners to Thailand B.E. …. with an effective period of 5 years from the date of its publication in the Government Gazette.

The acquisition of land to be used as residence for foreigners has been approved by the Cabinet in order to support the economic and investment stimulus measures by attracting high potential foreigners to Thailand, and provide opportunities for more diversified investments. 

The group of foreign nationals who have the required qualifications are:

1. Wealthy global citizens

2. Group of retirees from abroad (Wealthy pensioners)

3. Groups who want to work from Thailand (Work-from-Thailand professionals)

4. Specialists can reside and work in Thailand. (Highly skilled professionals)

What land can be held by foreigners

Land within Bangkok Pattaya City or municipality or within the area designated as a residential area under the law on town planning, size not exceeding 1 rai under section 96 bis of the Land Code and used for living for themselves only

Foreign investment

Foreigners with such high potential must invest at least 40 million baht in the type of business specified by the government. It must be beneficial to the economy and society of Thailand. Or is an activity that the Board of Investment (BOI) has announced as an activity that can apply for investment promotion under the law on investment promotion. And the investment period must not be less than 3 years

If the investment is withdrawn before the end of the capital maintenance period or before the end of 3 years, the right to receive from 1 rai of land must be suspended. 

The draft ministerial regulation can be reviewed every 5 years.
